MANILA – Prosecutors at the International Criminal Court (ICC) have formally opposed former president Rodrigo Duterte’s petition for interim release, urging the court to deny his request for transfer to a third country.

In a 15-page submission dated June 23, ICC Deputy Prosecutor Mame Mandiaye Niang asked the chamber in The Hague to reject the defense’s plea, citing the need to secure Duterte’s presence at trial and to prevent obstruction of proceedings or the commission of further crimes.

“The Prosecution’s position is that Mr. Duterte’s continued detention is necessary to ensure his appearance at trial, ensure that he does not obstruct or endanger the investigation or court proceedings, and prevent him from committing crimes within the jurisdiction of the Court,” the filing read.

Prosecutors also pointed to statements by Duterte and his family suggesting plans to bring him back to the Philippines. The prosecution cited reports that Duterte had expressed interest in returning to politics and even pledged to “double the killings” should he return.

“Mr. Duterte has reportedly previously stated that he planned to run for Mayor of Davao City again in 2025 and pledged to ‘double’ the killings the ‘moment I return.’ Mr Duterte has since won the Davao Mayoral election and his family has consistently stated their intention to bring him home,” the document said.

The prosecution further raised concerns over Duterte’s past threats against ICC officials and allegations that he and his allies had interfered in investigations against him.

Duterte remains in ICC custody as he faces charges related to alleged crimes against humanity committed during his administration’s bloody anti-drug campaign. (With reports from PNA)
