
MANILA – The Supreme Court of the Philippines En Banc denied the request of Sen. Ronald “Bato” Dela Rosa for a temporary restraining order (TRO) and/or status quo ante order (SQAO) that sought to prevent authorities from arresting him over any warrant linked to the International Criminal Court (ICC).
In a statement released, the High Court said the petition, docketed as G.R. No. 278747 and filed by former president Rodrigo Duterte and Dela Rosa against Executive Secretary Lucas Bersamin and others, was acted upon during the En Banc session on May 20, 2026.
The court said it denied Dela Rosa’s prayer for interim relief in a 9-5-1 vote.
In his manifestations before the court, Dela Rosa asked for a TRO and/or SQAO to stop the Department of the Interior and Local Government, Department of Foreign Affairs, Department of Justice, Philippine National Police, National Bureau of Investigation, Bureau of Immigration, Armed Forces of the Philippines, and Criminal Investigation and Detection Group from arresting him based on “any warrant from the International Criminal Court, red notice and diffusion from the International Criminal Police Organization, or any foreign judicial or quasi-judicial instrument without a Philippine judicial warrant.”
The Supreme Court said the full resolution, along with the separate concurring and dissenting opinions of the magistrates, will be uploaded to the court’s website on May 25, 2026.
It added that the ruling only covered the requests for interim relief and that the main issues raised in the pleadings and motions remain pending before the court.
